Employers and recruiters are independent organizations. Herald cannot guarantee that every third party will comply with its legal or contractual obligations.

If you believe a participating employer or recruiter has misused your information, contact us at [email protected].

7. Telephone, text message, and email communications

By providing contact information and requesting to be connected with employment opportunities, you authorize Herald to use that information to provide the service you requested.

Where required by applicable law, Herald will obtain any additional consent required before sending automated, prerecorded, artificial-voice, or marketing telephone or text communications.

Participating employers and recruiters are responsible for complying with applicable communication, telemarketing, text-message, email, and consent laws when contacting candidates.

You may withdraw communications consent or request that certain communications stop at any time.

Where text-message functionality is offered, instructions such as STOP may be provided for opting out of further text messages.

Withdrawing consent for optional marketing communications will not affect the lawfulness of communications sent before the withdrawal.

8. Service providers

We may disclose personal information to companies that provide services on our behalf, such as:

  • website hosting;
  • cloud infrastructure;
  • email delivery;
  • telephone or messaging services;
  • security;
  • analytics;
  • database management;
  • customer support;
  • professional services; and
  • compliance support.

Where required by applicable law, these providers are contractually restricted in how they may use personal information processed on our behalf.

A service provider’s precise role may depend on the service involved and the terms governing that relationship.

9. Analytics, advertising, cookies, and similar technologies

Herald may use cookies, pixels, analytics technologies, or similar tools to operate the website, measure performance, understand website traffic, prevent fraud, and evaluate marketing effectiveness.

Some third-party technologies may collect information directly from your browser or device.

Depending on the technology, configuration, contractual arrangement, and applicable law, a disclosure to an analytics or advertising provider may constitute processing for targeted advertising, a “sale,” or “sharing” of personal information.

Herald does not sell candidate contact information to advertisers for their own independent marketing purposes.

Where applicable law gives you the right to opt out of certain advertising-related disclosures, sales, sharing, or targeted advertising, you may exercise that right through our Privacy Request / Do Not Sell or Share mechanism.

Herald’s production advertising and analytics technologies must be configured consistently with this Privacy Notice.

10. Sale, sharing, and targeted advertising

Certain U.S. privacy laws define “sale,” “sharing,” and “targeted advertising” differently.

For example, under California law, a “sale” may include certain transfers of personal information for monetary or other valuable consideration. California “sharing” generally relates to disclosure for cross-context behavioral advertising.

A disclosure of candidate information to an employer or recruiter may, depending on the circumstances and applicable law, fall within a statutory definition of a sale or may instead constitute a disclosure intentionally requested or directed by the candidate.

Where Herald’s activities constitute a sale, sharing, or targeted advertising under applicable law, eligible consumers may opt out.

You may submit an opt-out through our Do Not Sell or Share / Privacy Request form or by contacting [email protected].

Herald will not discriminate against you for exercising a privacy right.

11. Global Privacy Control and opt-out preference signals

Where Herald is legally required to recognize a browser-based opt-out preference signal, such as Global Privacy Control (GPC), Herald will process that signal as required by applicable law.

The website’s technical implementation must be configured so that legally recognized opt-out preference signals are honored where required.

A GPC signal may apply only to the browser or device from which it is sent unless Herald is legally required and technically able to associate the signal with a broader account or identity.

12. Your privacy rights

Depending on where you live and whether the relevant privacy law applies to Herald, you may have the right to:

  • confirm whether we process your personal information;
  • know or access personal information we maintain about you;
  • obtain a copy of your personal information;
  • obtain portable personal information where required;
  • correct inaccurate personal information;
  • request deletion of personal information;
  • opt out of the sale of personal information;
  • opt out of certain sharing of personal information;
  • opt out of targeted advertising;
  • opt out of certain profiling or automated decision-making where applicable;
  • withdraw consent where processing is based on consent;
  • use an authorized agent where permitted by law;
  • appeal a decision we make concerning your privacy request; and
  • exercise your privacy rights without unlawful discrimination.

These rights are subject to applicable law and may contain exceptions.

13. How to exercise your rights

You may submit a privacy request through:

We may need to verify your identity before responding to certain requests. We will use only the information reasonably necessary to verify and process your request.

Opt-out requests will be processed within the period required by applicable law. Verified access, correction, portability, and deletion requests will generally be answered within 45 calendar days, or within another period required by applicable law.

Where permitted, we may extend the response period and will notify you if an extension is necessary. Deletion requests may be denied or limited where retaining information is permitted or required by law.

14. Appeals

Where applicable law gives you the right to appeal a decision concerning your privacy request, you may submit an appeal by emailing [email protected] using the subject line Privacy Appeal. Please identify the request or decision you are appealing. We will review and respond to eligible appeals within the period required by applicable law.

15. Authorized agents

Where applicable law permits an authorized agent to make a privacy request on your behalf, we may request evidence that the agent is authorized to act for you. We may also ask you to verify your identity directly unless applicable law provides otherwise.

16. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Notice, subject to legal, security, compliance, dispute-resolution, and recordkeeping requirements. Our intended retention framework is:

Candidate matching information

Candidate profile and matching information may generally be retained for up to 24 months after your last interaction with Herald, unless you request deletion earlier or a longer period is permitted or required by law.

Website and security information

Technical, website, analytics, and security records may be retained for a shorter or longer period depending on their purpose, including fraud prevention, security, troubleshooting, and legal compliance.

Consent and compliance records

Records concerning consent, privacy requests, opt-outs, and compliance activities may be retained for as long as reasonably necessary to demonstrate Herald’s compliance with applicable law or to establish, exercise, or defend legal claims.

A deletion request does not necessarily require deletion of information that applicable law permits or requires us to retain.

17. Security

Herald uses administrative, technical, and organizational safeguards designed to protect personal information. Information transmitted through the Herald website is protected using encrypted transmission technologies such as TLS where applicable. Access to personal information is restricted to personnel and service providers who reasonably require access for authorized purposes. No method of transmission or storage is completely secure, and Herald cannot guarantee absolute security.

18. Legal, safety, and compliance disclosures

We may disclose personal information where reasonably necessary to:

  • comply with applicable law, regulation, subpoena, court order, or lawful government request;
  • investigate or prevent fraud, security incidents, or unlawful activity;
  • protect the rights, safety, or property of Herald, our users, or others;
  • enforce agreements;
  • establish, exercise, or defend legal claims; or
  • obtain professional legal, accounting, compliance, insurance, or similar advice.

If Herald or ARB RECRUITMENT - NYC, LLC is involved in a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar corporate transaction, personal information may be transferred as part of that transaction where permitted by applicable law. Any recipient will remain subject to applicable privacy obligations concerning the information it receives.

20. Changes to this Privacy Notice

We may update this Privacy Notice as our services, technologies, business practices, or legal obligations change. When we make changes, we will update the Last updated date above. Where required by applicable law, we will provide additional notice or obtain additional consent before materially changing how we use personal information.
